Terms Of Service

Thank you for using Montana Tire Storage. Our goal is to make tire storage as easy as possible. In order to accomplish this, there are some ground rules we have to cover. This document is intended to set out the terms and conditions (the “Terms”) that govern all use of www.montanatirestorage.com and Montana Tire Storage services.

Please read this agreement carefully as both you and Montana Tire Storage are bound by the terms of this Agreement. Our Storage and Online Services are available to you only if you accept all policies comprised in this Agreement.

In this Agreement, Montana Tire Storage LLC, DBA Montana Tire Storage is referred to as “Montana Tire Storage” or the “Company”, and the customer is referred to as “you” or the “Customer”. Montana Tire Storage reserves the right to amend any portion of this Agreement at any time. The most up-to-date version of this Agreement can be found at the Montana Tire Storage website (Terms of Service).

Section 1: Montana Tire Storage Obligations

Montana Tire Storage will provide pickup, storage, and then delivery of Customer’s tires or what is presented as Customer’s tires by the Customer’s tire service provider within the Bozeman marketplace in exchange for a seasonal storage fee. There is a minimum storage fee of at least 6 months. Montana Tire Storage will not prorate any portion of a month or season where storage is not used. Montana Tire Storage agrees to deliver Customer’s tires within two business days of receiving a properly and successfully submitted delivery request. If Montana Tire Storage damages or loses Customer’s tires and or wheels, Montana Tire Storage will repair or replace Customer’s tires and or wheels up to $500 (five hundred dollars) with like property.

Section 2: Customer Obligations

Customer agrees to provide information needed to properly track their property such as name, email address, phone number, and the year, make, and model of the vehicle that the tires are used for. Customer agrees to confirm that their tire service provider can hold Customer’s tires for a period of at least two full business days prior to the time for tire changing and at least two full business days prior to the time for pick up by Montana Tire Storage. The tire service provider should also clearly mark Customer’s tires with Customer’s name for pick-up by Montana Tire Storage and firmly affixed any loose lug nuts or accessories. Montana Tire Storage does not track or store lug nuts and accessories that are not securely attached to Customer’s wheel tire assembly. Customer agrees to communicate with Montana Tire Storage when changes occur to their contact information or when delays in service cause a change in the requested pickup date. If Customer’s swap is delayed and Customer doesn’t notify Montana Tire Storage and it causes Montana Tire Storage to make an unnecessary trip, Montana Tire Storage may charge Customer $75.00. All fees and payments will be billed to the credit card on file. Delivery constitutes the conclusion of Montana Tire Storage responsibility. Subsequent pickup indicates the continuation of the agreement under the current Terms of Service. Failure to pay within 30 days communicates property abandonment and Montana Tire Storage may dispose of Customer’s property with no obligation to Customer. Customer agrees to request delivery and pickup of tires by submitting an online order form provided by Montana Tire Storage or by emailing at montanatirestorage@gmail.com. Delivery requests must be made with at least three business days notice during swap seasons (Oct 1-Nov 30 & April 1-May 31) and at least two business days during the off-season. If the Customer no longer wants tires that are in storage, Montana Tire Storage can deliver the tires to their home address or charge a $50 disposal fee.

Section 3: Representations of the Parties

Montana Tire Storage makes no representation as to the condition of or usability of Customer’s tires and or wheels nor the value of and the cost-effectiveness of tires being stored. It is our recommendation that Customer receive a professional evaluation of their tires and their tire’s value prior to submitting them for storage. Customer agrees that if they submit tires for storage they have determined that those tires are valuable enough to them to warrant storage.

Section 4: Additional Terms

Montana Tire Storage agrees to protect Customer’s privacy to the extent it can. Montana Tire Storage will not sell, rent, or give information regarding Customer except as needed to identify tires at the tire professional’s shop or to comply with law. Customer agrees to opt in as required to receive email invoices from Montana Tire Storage.

Section 5: Force Majeure

Montana Tire Storage shall not be obligated to deliver within its stated time schedule when events beyond its control occur such as floods, fires, traffic jams, or extreme weather. When such conditions end, Montana Tire Storage, shall reasonably resume its obligations.

Section 6: Governing Law

Prior to litigating any dispute arising out of this agreement, Customer agrees to mediate and/or arbitrate said dispute through a mutually agreed upon dispute resolution program. By agreeing to submit any dispute arising out of this agreement, Customer agrees that no dispute shall be submitted to arbitration prior to exhaustion of informal grievance procedures direct to Montana Tire Storage. Customer further understands that the arbitrator’s decision is legally binding on all parties involved in the dispute.

Section 7: Amendments

The only way either Montana Tire Storage can change any terms of this agreement is if that change is presented in writing or email to the Customer with at least 30 days notice before the change becomes effective.

Section 8: Assignment and Delegation

Neither party may assign or delegate unless the other party gives written consent, which will not be unreasonably withheld, before that assignment or delegation takes place.

Section 9: Severability

If any part of this agreement is invalidated the rest of the agreement shall remain valid and unchanged.

Section 10: Notices

Official or Legal correspondence shall be delivered to Montana Tire Storage, PO Box 10191, Bozeman, MT 59719.

Section 11: Entire Agreement

Both parties agree that this agreement is the complete agreement and no other agreement shall affect this agreement.

Section 12: SMS Messaging

At Montana Tire Storage, we value the privacy and trust of our customers. This Privacy Statement outlines how we collect, use, and protect your information when you opt to receive SMS messages from us.

1. Collection of Information

When you subscribe to our SMS messaging service, we collect the following information:

  • Phone Number: Used solely for the purpose of sending you scheduling updates and general questions.
  • Consent: By providing your phone number, you consent to receive SMS communications from Montana Tire Storage.

2. Use of Information

The information we collect is used to:

  • Send transactional or informational messages related to our services and products.
  • Provide customer support and address any inquiries you may have.
  • Analyze and improve our SMS messaging service to better serve you.

3. Data Protection

We are committed to ensuring the security of your personal information. We have implemented appropriate technical and organizational measures to protect your data from unauthorized access, use, or disclosure.

4. Sharing of Information

We do not sell, rent, or share your phone number with third parties for marketing purposes. However, we may share your information with trusted service providers who assist us in delivering our SMS services, under strict confidentiality agreements.

5. Opting Out

You have the right to opt out of receiving SMS messages at any time. To unsubscribe, reply with the word “STOP” to any SMS message you receive from us, or contact our customer service team. Upon receiving your opt-out request, we will remove your phone number from our SMS messaging list.

6. Changes to This Privacy Statement

We may update this Privacy Statement from time to time. Any changes will be posted on our website and will take effect immediately upon posting. We encourage you to review this statement periodically to stay informed about how we are protecting your information.

7. Non-Payment and Tire Disposal Policy

If payment for tire storage has not been received for a period exceeding three (3) months, Montana Tire Storage reserves the right to cancel your account. Upon account cancellation, Montana Tire Storage may, at its sole discretion, dispose of the stored tires without further notice. The customer acknowledges and agrees that Montana Tire Storage shall not be liable for any loss or damages resulting from the disposal of tires due to non-payment. It is the customer’s responsibility to ensure timely payments to avoid account termination and tire disposal.

Section 13: Tire and Wheel Detailing and Repair Service

  • Third-Party Services: MTS is here to make things easy, but the actual cleaning, detailing, or repair work will be performed by a third-party professional. We do not guarantee or warranty the quality or outcome of their work.
  • Release of Liability: You agree to release Montana Tire Storage, its team members, and its affiliates from any responsibility for any unexpected results, incidental damages, or service issues that may arise from the detailing or repair work.
  • Risk Acknowledgment: Tire and wheel services can involve minor risks (like finish imperfections or limitations based on prior wear and tear). By opting in, you acknowledge these risks.
  • Ongoing Storage: During storage, we will continue to take excellent care of your tires and wheels, but we are not responsible for any pre-existing damage, normal aging, or natural material changes over time.
  • Payment Terms: A 50% deposit is required before any work begins. The remaining 50% will be due upon completion, once you have had a chance to review and are satisfied with the results.
  • Cancellations: If you change your mind after placing a deposit but before the work starts, we will do our best to refund you, minus any expenses already incurred.
